JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-10-2019 This is an application for grant of anticipatory bail in connection with Marhowrah P. S. Case No. 612 of 2019, disclosing offences under Sections 30, 30(a) of the Bihar Excise and Prohibition Act, 2016.

As per F.I.R. police got a secret information that petitioners are engaged in trade of liquor, on that, police raided the place, the petitioners succeeded in fleeing away from the spot. There is recovery of 18 liters of liquor from there. Submission of the learned counsel for the petitioners is that they have falsely been implicated in this case. There is no source of information mentioned in the F.I.R. They have no criminal antecedent.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-XI-cum-Special Judge (Excise), Saran in connection with Marhowrah P. S. Case No. 612 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
