The petitioner seeks bail in connection with S. Tr. No. 194 of 2018 (arising out of Kishanganj P.S. Case No. 542 of 2018), registered under Section 363 of the Indian Penal Code. The accusation is of kidnapping of elder son of the informant.
Submission is that petitioner is not named in the first information report. In course of investigation, the elder son of the informant was recovered from the house of Jhana Devi where the petitioner and Arun Kumar were present. Further, submission is that in fact, the petitioner is resident of district Kishanganj and she had gone to Malda for her livelihood, but, on mere suspicion she was apprehended nearby the place where son of informant was recovered. Patna High Court CR. MISC. No.68932 of 2019(3) dt.18-02-2020 2/2 accused, Arun Kumar, has already been allowed the privilege of bail vide Cr. Misc. No. 16766 of 2019 by order, dated 03.05.2019. The petitioner, who is lady, has no criminal antecedent and is in custody since 04.09.2018. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with S. Tr. No. 194 of 2018 (arising out of Kishanganj P.S. Case No. 542 of 2018) to the satisfaction of the Additional Sessions Judge, III, Kishanganj.
