JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-10-2017 Heard the learned counsel for the petitioners. The petitioners seek regular bail in connection with Atri PS case no. 150 of 2017 registered for the offences punishable under Sections 414, 420, 467, 468/34 of Indian Penal Code.

The accusation against the petitioners is that when the police force were on patrolling, three persons were fleeing away leaving the motorcycle whereafter, they were apprehended and it transpired that the motorcycle which they had left, was a stolen one.

The learned counsel for the petitioners submits that no recovery has been made from the conscious possession of the petitioners, they do not have any criminal antecedent and similarly situated co-accused has already been granted bail vide order dated

Patna High Court Cr.Misc. No.49832 of 2017 (2) dt.17-10-2017 2/2 20.09.2017 passed in Cr.Misc. no. 45964 of 2017. For the reasons mentioned hereinabove, the petitioners are directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Atri PS case no. 150 of 2017.
