2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 8(b), 18, 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

3. As per F.I.R., this petitioner, along with other named accused persons, was involved in cultivation of opium on the forest land.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is neither owner of the land in question nor has got any concern with the alleged recovery. Petitioner has been made accused in this case only on suspicion. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cumSpecial Judge, NDPS Act, Gaya in connection with Barachatti P. S. Case No. 114 of 2021, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
