2. The petitioner has preferred this application for grant of regular bail in connection with Alipur P.S. Case No. 60 of 2024 dated 09.05.2024 registered for the offences punishable u/s 363, 366A of the IPC.

3. As per the prosecution case, on 07.05.2024, the daughter of the informant had gone to Tekari for study but did not return. It is alleged that the daughter of the informant used to talk to one Manjit Kumar (petitioner) who is a tempo driver and with whom she used to go to Tikri Bazar. Informant believes that the petitioner has kidnapped her daughter.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.77007 of 2024(4) dt.21-04-2025 2/2 that the petitioner is innocent and has falsely been implicated in this case due to suspicion. He further submits that petitioner has love affair with the victim and she used to talk with Manjit Kumar @ Mantira Kumar (petitioner). The victim in her statement recorded under Section 164 Cr.P.C., has not levelled any allegation of sexual assault against the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 12.05.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned/A.C.J.M. VI, Gaya in connection with Alipur P.S. Case No. 60 of 2024.

7. The application stands allowed.
