2. This is the 2nd attempt of the petitioner in connection with Kahalgaon P.S. Case No. 250 of 2024 registered for the offence under Sections 363, 365 of the Indian Penal Code and later on charge sheet has been submitted under Sections 366(A), 376 of the IPC and Section 4 of the POCSO Act.

3. Earlier the bail application of the petitioner was rejected on 09.04.2025 in Cr. Misc. No. 2093 of 2025 which reads as follows:- Heard the parties.

2. The petitioner seeks regular bail in

Patna High Court CR. MISC. No.70797 of 2025(2) dt.07-11-2025 2/2 connection with Kahalgaon P.S. Case No.250 of 2024 registered for the offence punishable under sections 363, 365 and 376 of the Indian Penal Code and under section 4 of the POCSO Act.

3. It is alleged that the petitioner has kidnapped a minor girl and committed rape with her. He is in custody since 12.04.2024.

4. Considering the nature of allegation levelled against the petitioner, I am not inclined to grant the petitioner privilege of regular bail. Accordingly, this bail application is rejected.

4. Mr. Ranjan Kumar Jha, the learned counsel for the petitioner very fairly has submitted that out of six prosecution witnesses, five witnesses have been examined and the trial is on the verge of conclusion.

5. In view of the above, I am not inclined to grant regular bail to the petitioner. Accordingly, this application for regular bail is hereby rejected.

6. The Court below is directed to conclude the trial at the earliest.
