JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Sheikhpura Mahila P.S. Case No.40 of 2017 registered under Section 67 (kh) of the Information and Technology Act and Section 8 of the Protection of Children from Sexual Offences Act, 2012 . As per the prosecution case, the petitioner along with his two other brothers are said to have made video of the informant at the time of taking bath by her on the well. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in this case due to land dispute between the parties. The petitioner happens to be the neighbor of the informant and the mother of the informant had taken away the aforesaid mobile from his house a day preceding to the occurrence

Patna High Court Cr.Misc. No.50499 of 2017 (02) dt.18-10-2017 2/ 2 and falsely implicated him in the case. The petitioner has been languishing in custody since 22.08.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional District & Sessions Judge, Sheikhpura in connection with Sheikhpura Mahila P.S. Case No.40 of 2017.
