====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 21-11-2024 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Sherghati (Dobhi) Police Station Case No.38 of 2024, dated 02.04.2024, disclosing offences under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that petitioner along with other co-accused persons armed with weapons, revolver etc., assaulted the informant and his family members due to which they sustained injuries. petitioner no. 2 has allegedly assaulted Uday Yadav by falsa and the petitioner no. 1 is a lady who along with Kanchan Devi and
Patna High Court CR. MISC. No.77716 of 2024(2) dt.21-11-2024 2/3 Jira Devi, allegedly assaulted Pankaj Yadav and Chhotu Yadav.

Learned Counsel for the petitioners submits that petitioners have falsely been implicated in this case due to previous dispute inasmuch as husband of petitioner no.1 had lodged Sherghati (Dobhi) P.S. Case No. 396 of 2021 under various sections of I.P.C including sections of S.C./S.T. Act. Referring to Annexure-P/2, injury report of the victims, learned counsel submits that victims have sustained simple injury.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that there is a previous case pending between the parties and the injuries caused to the victims are simple in nature and petitioner no.1 is a lady, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st Sherghati, Gaya, in connection with Sherghati (Dobhi) Police Station Case No. 38 of 2024, subject to the condition laid down
