The petitioner seeks regular bail in connection with Harsidhi P.S. Case No. 398 of 2015 registered for the offences under Sections 25(1)(a), 25(1)(b), 25(1-B) and 26 of the Arms Act.
The allegation against the petitioner is that he was running an illegal arms making factory and while he was apprehended he was making trigger of guns and some cartridges are also said to have been recovered.
The learned counsel for the petitioner submits that the petitioner has a clean antecedent and he is languishing in custody since 22.10.2015.
Having regard to the facts and circumstances of the case
Patna High Court Cr.Misc. No.53403 of 2017 (2) dt.09-11-2017 2/2 as also long incarceration of the petitioner, I deem it fit and proper to enlarge the petitioner above named, on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-IX, East Champaran at Motihari in connection with Harsidhi P.S. Case No. 398 of 2015.
It is directed that the petitioner shall remain present before the learned trial court on each and every date fixed in the case and if there are two consecutive defaults in his attendance, the privilege for bail shall stand withdrawn and he shall be taken into custody forthwith.
