JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Andhramath P.S. Case No. 20 of 2017 initially, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and subsequently, Section 302 of the Indian Penal Code was added.

At the very outset, it is pointed out that having more or less similar allegation, four co-accused, namely, Permeshwari Devi, Chandani Devi, Geeta Devi @ Gita Devi and Janaki Devi have already been granted privilege of anticipatory bail by a coordinate Bench of this court vide order dated 07.12.2017 passed in Cr. Misc. No. 57497 of 2017.

No.19200 of 2018 (2) dt.05-04-2018 2/2 Perusal of first information report goes to show that no specific overt-act has been attributed against the petitioner and her case is on similar footing to those co-accused, who have already been granted privilege of anticipatory bail. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of her arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-2nd , Jhanjharpur, District Madhubani in Andhramath P.S. Case No. 20 of 2017 subject to condition as laid down under Section 438(2) of the Cr.P.C.
