JUSTICE RAKESH KUMAR ORAL ORDER 11-07-2018 Heard Sri Ramchandra Singh, learned counsel for the petitioner and learned A.C. to A.A.G. No. 15. The present petition has been filed with a prayer to initiate contempt proceeding against opposite parties on an accusation of willful disobedience to an order dated: 27.01.2016 passed in C.W.J.C. No. 7723 of 2011. By the said order writ petition was disposed of with direction to consider the grievance of petitioner in respect of payment against leave encashment.

Patna High Court MJC No.2983 of 2017(5) dt.11-07-2018 2/2 In this case, a show- cause has been filed on behalf of opposite party no. 4. Along with the show- cause an office order dated: 14th December, 2017 has been brought on record vide Annexure- 'A'. Learned State Counsel submits that in compliance with the order of writ court grievance of petitioner was examined and after examination it was found that he was not entitled to get such relief, and as such, his claim has been rejected by a reasoned order. Learned State Counsel submits that some delay has occurred in passing order, but it was not intentional.

Considering the facts and circumstances and the fact that in compliance with the order of writ court a reasoned order has been passed, there is no reason to further keep the matter pending.

The petition stands disposed of with observation that if petitioner feels aggrieved with Annexure - 'A' to the showcause, he would be at liberty to avail appropriate remedy. (Rakesh Kumar, J) praful/- U T
