ANJANA MISHRA ORAL ORDER 24-10-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 04.08.2019 in connection with Special case No. 6957 of 2019 registered for the offence punishable under Sections 414 of the Indian Penal Code and Section 30(a) of the Bihar Excise and Prohibition Act. Learned counsel for the petitioner submits that the alleged recoveries were made not from the conscious possession of the petitioner, but from the motorcycle and the allegation of theft of vehicle is also false as he had purchased the same from one Ashiana Automobiles Pvt. Ltd. on 21.01.2019. He further submits that save and except two antecedents, the petitioner is not having any other case.

In view of the aforementioned facts and

No.66923 of 2019(2) dt.24-10-2019 2/2 circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special case No. 6957 of 2019.
