2. The petitioner seeks regular bail in a case registered for the offence under Sections 420, 414, 465, 468, 34 of the Indian Penal Code.

3. As per the prosecution case, petitioner was caught riding stolen motorcycle.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He is in custody since 21.08.2023. Petitioner has got no concern with the alleged recovery.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the

Patna High Court CR. MISC. No.72695 of 2023(2) dt.09-11-2023 2/2 case, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.F.C, Aurangabad/concerned Court below in connection with Kasma P.S. Case No. 146 of 2023 subject to conditions that:- 7(i)The petitioner will mark his attendance at the Kasma, Aurangabad Police Station on the first and thirdSunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
