The petitioners seek anticipatory bail in connection with Gopalpur PS case no. 71 of 2017 dated 18.4.2017 registered for the offences punishable under Sections 147, 148, 149. 341, 323, 307, 353, 188 and 504/506 of the Indian Penal Code. The allegation is regarding the petitioners herein and other accused persons engaging in brick batting and assaulting the police personnel.
The learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in the present case as well as they are having a clean antecedent. Having regard to the facts and circumstances of the case, it is
Patna High Court Cr.Misc. No.5222 of 2018 (3) dt.23-02-2018 2/2 directed that the petitioners shall be admitted to the privilege of anticipatory bail subject to deposit of Rs.6,500/- each before the Nazarat of the concerned court.
Accordingly, it is directed that in case the petitioners surrender before the concerned court within a period of two weeks from today and show the receipt of the deposit of the said amount of Rs. 6,500/- each, the petitioners above named shall be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Naugachia, District Bhagalpur in connection with Gopalpur PS case no. 71 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
