JUSTICE RAKESH KUMAR ORAL ORDER 10-11-2017 Heard Sri Rajeev Ranjan, learned counsel, assisted by Sri Anil Kumar, learned counsel for the petitioner and Sri Narendra Kumar Singh, learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Piro P.S. Case No.206 of 2017 registered for the offence under Sections 30(a) and 56 of the Bihar Prohibition and Excise Act,2016, has prayed for grant of bail, in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that save and except confessional statement of co-accused, there is no other material to connect the petitioner in the present case. Learned counsel for the petitioner has drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent.

Patna High Court Cr.Misc. No.50904 of 2017(2) dt.10-11-2017 2/2 Sri Narendra Kumar Singh, learned Addl. Public Prosecutor, opposing the prayer for anticipatory bail, submits that from the F.I.R. it appears that the petitioner is a supplier of liquor. However, he is not in a position to dispute that the petitioner's name has come on the basis of confessional statement of co-accused and beyond that there is no other material.

Considering the fact that the petitioner has been made accused on the basis of confessional statement of co-accused as well as clean antecedent, let the petitioner, namely, Bahadur Singh Yadav @ Bir Bahadur Singh , in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District Judge-IV, Ara, District-Bhojpur in connection with Piro P.S. Case No.206 of 2017 corresponding to Excise Case No.4029 of 2017, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J) nawalkrs/- U T
