JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-12-2017 Heard the learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks bail in connection with Hathauri P.S. Case No. 99 of 2017 dated 21.06.2017 instituted for the offence under Section 366 of the Indian Penal Code. The petitioner is alleged to have taken the daughter of the informant along with her while she was going for her treatment. Later, the petitioner is said to have come back home but the daughter of the informant never returned. The daughter of the informant was later recovered and she gave a statement under Section 164 Cr. P.C. that about four or five persons, who have been named by her, forcibly took her to Rajasthan where she was made to marry one Ramod Rai @ Ramoj Kumar under duress. After about 15 days of the marriage, she was recovered by the
Patna High Court Cr.Misc. No.52907 of 2017 (3) dt.22-12-2017 police. She expressed her desire to stay with her parents. Later, a development took place in this case whereby settlement was arrived at between the parties. The informant who is the father of the victim has also no objection to his daughter continuing with the marital relationship with the aforesaid Ramod Rai @ Ramoj Kumar.
Learned counsel for the petitioner has submitted that but for the fact that the petitioner was instrumental in taking the daughter of the informant out of the house from where she was abducted, there is no further allegation against her of either forcing her to marry Ramod Rai @ Ramoj Kumar or of having tortured her in any way.
The petitioner is in custody since 27.08.2017. For the aforestated facts as also the age of the victim girl which is said to be 18 years, the petitioner above named is directed to be released on bail on her furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Muzaffarpur in connection with Hathauri P.S. Case No. 99 of 2017.
