The petitioner apprehends his arrest in a case registered for the offence punishable u/s 392 of the IPC. Allegedly, three miscreants looted Rs.75,000/- and other articles from the informant while he was on Ara Salampur Matiyapur Road.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. Petitioner is not named in the F.I.R. and his name transpired in this case on the confessional statement of a co-accused namely Dablu Kumar. No incriminating article has been recovered from the conscious physical possession of the petitioner. Petitioner has no criminal

Learned APP for the State opposed the prayer for bail by submitting that on the statement of the co-accused Dablu Kumar, some of the looted article has been recovered. Having regard to the facts and circumstances of the case, considering the nature of offence, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

This application is accordingly dismissed.
