JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-12-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the state.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Uchkagaon P.S. Case No. 69 of 2016 for the offences punishable under sections 304 (B) and 120 (B)/34 of the I.P.C.

Puja Kumari, the daughter of the informant, was married to Fool Kumar, the son of petitioner nos. 1 and 2 on 07.03.2014 and allegedly due to non fulfillment of demand of dowry she was killed by the petitioners and other in-laws. Submission is of false implication and that the petitioner nos. 1 and 2 are old father-in-law and mother-in-law,

Patna High Court Cr.Misc. No.51068 of 2017 (3) dt.14-12-2017 2/2 whereas, petitioner no.3 is Gotni, they are living separately since long, the informant after realizing the truth has filed a petition in the court below stating that her daughter committed suicide and being instigated by the villagers of village- Jhirwa she has lodged the case, the in-laws of her daughter are innocent, the compromise petition is Annexure-2 and as such the petitioners deserve sympathetic consideration.

The learned A.P.P. fairly submits that now the informant is retracting from her earlier version. In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M-IX, Gopalganj in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
