The petitioner is in custody in connection with Dhamdaha P.S. Case No. 198 of 2019 for the offenses under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that F.I.R. has been lodged against unknown persons. The petitioner has no criminal antecedent. Allegation against the petitioner in the instant case is that he was involved in the theft of motorcycle of the informant. The petitioner was not named in the F.I.R. The petitioner is in custody since 22.08.2019.

Considering the fact that the petitioner was not named in the F.I.R, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on
