JUSTICE ARVIND SRIVASTAVA ORAL ORDER 22-11-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Kochadhaman P.S. Case No. 118 of 2017 registered for the offence punishable under sections 302, 120B/34 of the Indian Penal Code.
Learned counsel appearing for the petitioners submits that petitioners have been implicated in this case merely on suspicion. The deceased has committed suicide which would be apparent from the Post Mortem Report wherein cause of death has been opined due to Asphyscia and Shock as a result of
Patna High Court Cr.Misc. No.52374 of 2017(3) dt.22-11-2017 2/2 hanging. No external or internal injury was found on the body of the deceased. Moreover, charge sheet has been submitted in this case under section 306 I.P.C. only. Petitioners have no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner nos. 2, 3, 5, 6, 7, 8 and 9, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, I, Kishanganj, in connection with Kochadhaman P.S. Case No. 118 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
