The petitioners, who are in custody, seek bail in connection with Jalley P.S. Case No. 73 of 2017 registered for the offence punishable under Section 379 and 411/34 of the Indian Penal Code.

The informant has alleged theft of his tractor from his shop and same was recovered from one Md. Akbar. Learned counsel for the petitioner submitted that on confessional statement of Md. Akbar, the name of the petitioners have transpired in this case, except confessional statement made by said Md. Akbar there is no other incriminating materials against the petitioners.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Darbhanga, in connection with Jalley P.S. Case No. 73 of 2017.
