====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-01-2025 Anticipatory bail application with regard to petitioner Nos. 1 & 2 has already been withdrawn vide order No. 2 dated 25.11.2024.
2. Heard learned counsel for the petitioner and the State.
3. Petitioner No. 3 apprehends arrest in a case registered for the offences punishable under Sections 8, 15, 18(c), 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
4. According to F.I.R., this petitioner, along with other accused persons, wereinvolved in illegal cultivation of opium in the forest area.

5. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Name of the petitioner transpired only on the basis of confessional statement of co-villagers. Allegation against petitioner is general and omnibus. The land in question on which opium cultivation was being done does not belong to the petitioner and he is not concerned with the same. Petitioner has got clean antecedent.
6. Learned A.P.P. for the State vehemently opposed the bail application.
7. Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge-cum-Special Judge, NDPS Act, Gaya in connection with Dhangai P. S. Case No. 32 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
