JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-03-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 307/354B/504 and other ancillary sections of the Indian Penal Code. Prosecution case is that on objection being raised over construction of road by the informant, accused persons including the petitioner assaulted the informant and her family members causing them injuries.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Earlier petitioner had filed Ramgadhwa Police Station Case No. 201/2021 against the informant thereafter the instant case was lodged by the informant to save her skin from the earlier case filed the petitioner. Petitioner has got no criminal antecedent.

No.70708 of 2022(2) dt.21-03-2023 2/2 Considering the backdrop of the incident and the fact that the petitioner has got no criminal antecedent, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in Ramgadhwa Police Station Case No. 202/2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
