JUSTICE ANIL KUMAR SINHA ORAL ORDER 06-11-2019 The petitioner apprehends his arrest in connection with Deepnagar P. S. Case No. 236 of 2019 registered under Sections 147, 148, 149, 224, 225, 307, 323, 324, 337, 338, 341 and 353 of the Indian Penal Code and 27 of the Arms Act. Allegation against the petitioner is that petitioner along with other accused persons attacked upon the police party and rescued a person namely Ajay Singh, who was arrested by the police from his house in the village.

Mr. Surendra Kumar Singh, learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case at the behest of village Chaukidar with whom petitioner had some previous dispute. He further submits that petitioner is a Government servant and he is working as Chaukidar in a Government college. He also submits that

Patna High Court CR. MISC. No.65341 of 2019(2) dt.06-11-2019 2/2 allegation against the petitioner is general and omnibus in nature and the injuries caused to the informant have been found to be simple in nature.

Having regard to the submissions made by the parties and taking into consideration the fact that there is no specific allegation against the petitioner and petitioner is a Government employee, as such I am inclined to grant anticipatory bail to the petitioner.

Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Nalanda at Biharsharif in connection with Deepnagar P.S.Case No. 236 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
