2. The instant application for anticipatory bail has been filed by the petitioner apprehending their arrest in connection with Sikraul P.S. Case No. 116 of 2023 instituted for the offence under Sections 147, 341, 323, 307, 379 and 504 of the Indian Penal Code.
3. The case of the prosecution is that the informant has went for walk in the morning, at that time, all the accused persons started abusing the informant. When the informant
Patna High Court CR. MISC. No.75981 of 2024(2) dt.25-11-2024 2/3 objected, they started assaulting with lathi-danda. Specific allegation is against Prem Raj that he assaulted with Baisakhi on the head of the niece of the informant.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioners are innocent and have committed no offence. They have falsely been implicated in this case. From the perusal of the impugned order, it is clear that in the occurrence, six persons received injury and the nature of the injury is simple in nature. The allegation against only Prem Raj is specific and other petitioners are having only general and omnibus allegation.
5. In contra, learned APP appearing for the State opposes the prayer of bail of the petitioners.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Sikraul P.S. Case No. 116 of 2023, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial
