JUSTICE RAJIV ROY ORAL ORDER 20-01-2023 Heard learned counsel for the petitioner and the State through video conferencing in view of the Covid-19. The petitioner apprehends his arrest in connection with Aurangabad (Muffasil) P.S. Case No. 379 of 2022 instituted under Sections 30(a) of Bihar Prohibition and Excise Amendment Act, 2018.

As per the prosecution story, in course of patrolling, the police came to know that the named accused are carrying huge quantity of wine on white Bolero and accordingly tried to intercept the same but the driver parked the vehicle and managed to escape. Accordingly, the vehicle was searched and seizure list was prepared.

Learned counsel for the petitioner submits that he do not have any role to play in this case.

Patna High Court CR. MISC. No.72552 of 2022(2) dt.20-01-2023 2/2 Learned APP on the other hand opposes the prayer for bail.

Taking into account the fact that the name of the petitioner came in this case and the petitioner has criminal antecedent(s) of the same nature, certainly it is not a fit case for extending benefit of anticipatory bail which is accordingly rejected.

If however, the petitioner(s) surrenders within four weeks from today before the concerned court and file bail petition along with relevant documents, the court shall take into account the facts and dispose of the same expeditiously without being prejudice by observation of this Court.
