The petitioners seek bail in connection with Digha P.S. Case No. 282/2017 dated 05.09.2017 instituted for the offences under Sections 144, 145, 146, 147, 148, 149, 114, 115, 342, 323, 307, 353, 395, 397, 186, 332, 333, 336, 337, 338, 427 and 504 of the Indian Penal and Section 27 of the Arms Act. The allegation against the petitioners is of congregating at the place of occurrence and damaging the property of the Housing Board.

Learned counsel for the petitioners submits that no specific allegation has been levelled against them and they can, at best, be said to be members of the mob.

Patna High Court Cr.Misc. No.53321 of 2017 (3) dt.29-11-2017 2/2 The petitioners are in custody since 06.09.2017. Many of the other co-accused persons with similar allegation against them have been enlarged on bail by different Benches of this Court.

Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioners.

The petitioners above named are directed to be released on bail on their furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Patna in connection with Digha P.S.
