JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks pre-arrest bail in connection with Khagaria (Gangaur) P. S. Case No. 428 of 2017 registered under Sections 420, 468 and 471/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that the petitioner was posted as Branch Manager, State Bank of India, Jalkaura from 03.01.2015 to 24.10.2016. The informant Pramila Devi had approached the State of Bank of India, Jalkaura Branch and presented all relevant documents and signed all relevant forms and papers and sought KCC loan of Rs.64,000/- from the Bank, which was duly sanctioned on

Patna High Court Cr.Misc. No.9344 of 2018 (2) dt.17-02-2018 2/2 06.11.2015 and, thereafter, on 06.11.2015 itself Rs.64,000/- was credited to the loan account of the informant and on 06.11.2015 itself Rs.64,000/- was transferred to SBI Account No.35228620267 of the informant. It is further submitted that prior to sanction of loan, the land possession certificate was verified by the field officer of the Bank and it is wrong to allege that the informant possesses no agricultural loan. Learned Additional Public Prosecutor for the State opposed the prayer for grant of pre-arrest bail to the petitioner. Considering the nature of allegation and the submission made above, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.

10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Khagaria in Khagaria (Gangaur) P. S. Case No. 428 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
