2. The petitioner seeks regular bail in connection with Pipra P.S. Case No. 157 of 2023 instituted for the offences punishable under Sections 457 and 380 of the Indian Penal Code.
3. It is a case of stealing of several items from PHC, Pipra hospital.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that nothing has been recovered from the possession of the petitioner, petitioner is not named in the FIR, he is in custody since 28.05.2023 and similarly situated co-accused
Patna High Court CR. MISC. No.80034 of 2023(2) dt.19-12-2023 2/2 person has already been granted regular bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 54122 of 2023 vide order dated 24.08.2023.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. Considering the facts and circumstances of the case and the period of detention of the petitioner as well as the fact that similarly situated co-accused has already been granted bail by a Co-ordinate Bench of this Court, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari in connection with Pipra P.S. Case No. 157 of 2023.
