The petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code.

The prosecution case, in short, is that the informant went to withdraw money from ATM but she could not be succeeded. A boy standing there came there to help her and similarly, the informant could be able to withdraw Rs. 2000/- When she came to her house, she noticed that RS 73,000/- was fraudulently withdrawn from her account.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 23-06-2019. Charge sheet has already been submitted. The petitioner is not named in

Patna High Court CR. MISC. No.64118 of 2019(2) dt.17-10-2019 2/2 the FIR. He has been made accused on the basis of selfconfessional statement of the petitioner made before the police. There is no recovery of any incriminating article from possession of the petitioner. He has not been put on test identification parade.

On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Diwakar Kumar, learned Judicial Magistrate-Ist Class, Nawada in connection with Pakribarawan P.S. Case No. 47 of 2019.
