The petitioners seek bail in connection with Pipra P.S. Case No. 215 of 2016 dated 20.12.2016 instituted for the offences under Sections 302 and 120(B)/34 of the Indian Penal Code.

The dead body of the younger brother of the informant was found in the house of the petitioner no. 1 who is the aunt of the informant as well as the deceased. In the FIR, it has been alleged that the deceased had come back from Delhi and had gone to the house of petitioner no. 1, as the deceased had been transacting money with her. The learned counsel for the petitioner has submitted that the husband and father of the petitioners respectively have been granted bail by a Bench of this Court vide order dated 23.11.2017 passed in Cr. Misc. No. 56305 of 2017. Even Raushan Yadav, against whom the informant has suspicion that he is the main person behind the killing of the deceased, has been granted bail by another Bench of this Court vide order dated 20.09.2017 passed in Cr. Misc. No. 42536 of 2017.

Learned counsel for the petitioner has submitted that the petitioner no. 1 is an old lady whereas petitioner no. 2 is an unmarried girl of the house and there is no eye witness to the occurrence.

The petitioners are in custody since 18.07.2017. For the facts stated above, the petitioners above named are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Pipra P.S.
