The petitioner seeks bail in connection with Muffasil (Lakhaura) P. S. Case No. 430 of 2015 dated 18.12.2015 which was initially instituted for the offence under Section 27 of the Arms Act, 1959 but later Sections 392 and 120B of the Indian Penal Code were added.

Two miscreants, came from Motihari side on a motor-cycle and opened fire, whereafter they left. There is no report of any loot from the petrol pump where firing was resorted to. One Moti Lal Paswan is said to

Patna High Court CR. MISC. No.68011 of 2019(2) dt.04-12-2019 2/2 have been arrested during the course of investigation, who has named the petitioner. Beyond this, there is no other material to connect the petitioner with the offence. The petitioner has not even been put on Test Identification Parade as yet. He is in custody since 29.07.2019. In one case in which the petitioner has been made accused earlier, he has been granted anticipatory bail.

Considering all these facts, the petition is allowed.

The petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 9TH Additional Chief Judicial Magistrate at Motihari, East Champaran in connection with Muffasil (Lakhaura) P. S. Case No. 430 of 2015.
