1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Alamnagar Police Station Case No. 324 of 2022, disclosing offences under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code.

3. As per the allegation, the petitioner has obtained employment as Panchayat Teacher on the basis of fake educational certificate.

4. Learned senior counsel for the petitioner argues that the petitioner had produced the genuine marksheet and certificate before the employment unit at the time of his appointment but due to some mistake in the roll number

No.75864 of 2023(4) dt.07-03-2024 2/3 mentioned in the certificate issued by the Intermediate Council, the confusion has arisen and the Vigilance Officer of the Bihar School Examination Board, Patna, has given the remarks that the educational certificate of intermediate in science of the petitioner is fake. Referring to the marksheet of I.S.C. issued by the Intermediate Education Council, Patna, learned counsel submits that the petitioner had obtained a total marks of 531 having roll No. 10010 and was awarded second division but the certificate, granted by the Bihar Intermediate Education Council, dated 4th June, 1993, inadvertently, mentioned the roll number of the petitioner as 10009 instead of 10010. The petitioner, in this regard, filed a writ application bearing CWJC No.

3297 of 2023 before this Court and successor body of Intermediate Council i.e.

Patna High Court CR. MISC. No.75864 of 2023(4) dt.07-03-2024 3/3 correct roll number of the petitioner as 10010 instead of 10009.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that Bihar School Examination Board, after verification of record, has issued the corrected certificate having the correct roll number of the petitioner, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Madhepura, in connection with Alamnagar Police Station Case No. 324 of 2022, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
