The petitioner seeks pre-arrest bail in connection with Bagen Gola P.S. Case No. 08 of 2011 dated 07.03.2011 instituted for the offences under Sections 302 and 201 of the Indian Penal Code.

The petitioner though is not named in the FIR but his implication in this case is on the basis of clinching materials which have been collected during the course of investigation. A headless dead body was found in the field by the Chowkidar. From near the dead body, a military bag was recovered which contained blood stained iron implements like knife etc. On proper search of the place in and around the dead body, a black coloured bag of Adidas make was also found in

Patna High Court Cr.Misc. No.55412 of 2017 (3) dt.18-01-2018 which a SIM card and identity card of one Md. Sarfaraj Anwar was found. The SIM was later found to be standing in the name of said Md. Sarfaraj Anwar.

During the course of investigation it came to light that because the daughter of the petitioner had developed close association with the deceased, Md. Sarfaraj Anwar, therefore he has been killed.

Though the basis of the implication of the petitioner in this case is only on the basis of suspicion but the suspicion gets concretized by the fact that the daughter of the informant had earlier approached the District Magistrate, Buxar for providing safety to her life and had represented before the District Magistrate, Buxar, that the petitioner i.e. her father and her brothers have been ill-treating her for her staying singly and carrying on with her work. The daughter of the petitioner as well as the deceased were working as teachers in a local school. Considering the aforesaid facts, this Court is not inclined to grant anticipatory bail to the above named petitioner. Accordingly, the same is rejected.
