The petitioner seeks bail in a case registered for offence under sections 147, 148, 149, 121A, 120B of the IPC and under the Arms Act.

Police chased and apprehended suspected naxalites including the petitioner and recovered one loaded country made pistol and 8 live cartridges from his possession. Counsel for the petitioner submits that one of the similarly apprehended accused with the petitioner, has already been allowed bail by a bench of this Court vide order dated 5.7.2017, passed in Cr.Misc.No. 25133 of 2017 and the petitioner is in custody since 2.2.2017 having no antecedent.

In the facts of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as mentioned above, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Jamui in Chakai Police Station Case No. 08 of 2017 on the following

No.56231 of 2017 (3) dt.13-12-2017 conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with him. The bailor will also undertake to inform the court if there is any change in the address of the petitioner. (b) The petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
