Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 13-C/19 registered for the offences punishable under Sections 341/342/323/504 and 498(A) of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Though the matter was referred to Patna High Court Mediation Centre and the mediation report has not been received, but Shri Ram Sumiran Rai, learned counsel for the petitioner submits that the matter has been settled and the parties have decided to part ways.

Considering the above submission of learned counsel

Patna High Court CR. MISC. No.71148 of 2019(9) dt.18-04-2022 2/2 for the petitioner, the prayer of the petitioner for grant of anticipatory bail is allowed.

Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Begusarai, in connection with Complaint Case No. 13-C/19, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

At the time of accepting the bail bond of the petitioner, the Court below shall verify from the complainant as to whether the matter has been settled or not. If the matter is found to be settled, the bail bond of the petitioner is accepted and if the Court below finds that there has been no settlement between the parties then the petitioner shall be taken into custody.

With the aforesaid observation and direction, this application is allowed.
