JUSTICE BIRENDRA KUMAR ORAL ORDER 06-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 12.04.2016 in connection with Alamganj P.S. Case No.292 of 2015, a case under Section 304B of the Indian Penal Code.

The petitioner is husband of the victim. There is allegation of commission of dowry death. Earlier this Court had refused the prayer for bail on 14.12.2016 with direction to the learned trial Court to expedite the trial and the liberty to the petitioner to renew the prayer for bail after completion of nine months in custody.

Learned counsel for the petitioner submits that only two prosecution witnesses have been examined uptil now. The petitioner is ready to fully cooperate with the trial in the

Patna High Court Cr.Misc. No.59388 of 2017 (2) dt.06-12-2017 P2/ event of release.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Sessions Trial No. 562 of 2016/562A of 2016, arising out of Alamganj Police Station Case No. 292 of 2015, with condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner and release only after conclusion of the trial.
