Petitioner apprehends arrest in connection with Atri P.S. Case No. 376 of 2023 registered for the offences under Section 409 of the Indian Penal Code and Section 7 of the Essential Commodities Act.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. Further submission is that the matter relates to Essential Commodities Act and the petitioner is a P.D.S. dealer against whom no complaint has ever been made by the beneficiaries. It is also submitted that the present F.I.R. has been lodged on the basis of suspicion and misunderstanding and the
Patna High Court CR. MISC. No.77081 of 2023(2) dt.29-11-2023 2/2 petitioner has no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of A.C.J.M.-X, Gaya in connection with Atri P.S.
