2. The petitioner seeks bail in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 115, 126(2), 118(2) and 109 of B.N.S., 2023.

3. As per F.I.R., this petitioner along with co-accused persons variously armed with sword, knife and rod assaulted Shivam Kumar. When he tried to flee in order to save his life, all the accused persons assaulted him with sword as a result of which he sustained sharp cutting injury on his head.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged. The allegation of assault is general and omnibus in nature. F.I.R.

Patna High Court CR. MISC. No.69797 of 2025(3) dt.02-12-2025 2/2 does not attribute any specific role against this petitioner. Petitioner has got clean antecedent and is in custody since 30.06.2025. Charge-sheet has been submitted.

5. Learned A.P.P. for the State vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Town) P.S.
