The petitioner seeks bail in Supaul P.S. Case No. 444 of 2017 registered under Section 379 of the Indian Penal Code.
As per the prosecution case, the motorcycle of the informant is said to have been stolen by some unknown persons and the stolen motorcycle was recovered from the possession of the petitioner.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case. No incriminating article has been recovered from his conscious physical possession. There is nothing in the case diary indicating the complicity of the petitioner in the occurrence. As a matter of

No.54520 of 2017 (02) dt.14-12-2017 - 2 - fact, one Pawan Kumar Jha had given him the aforesaid motorcycle for riding on it and he had no knowledge that the said motorcycle is stole one. The petitioner happens to be a student and has been languishing in custody since 21.08.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No.444 of 2017.
