02. In the present case, the petitioner seeks bail in connection with Bhagwan Bazar P.S. Case No. 75 of 2025 registered for the alleged offences under Sections 317(2) and 309(4) of Bharatiya Nyaya Sanhita, 2023.
03. As per prosecution case, petitioner and co-accused snatched Rs. 16,000/- from the informant when the informant boarded in e-rickshaw for going to bus stand.
04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner has been arraigned in this case merely on suspicion. Though there is allegation of recovery of articles belonging to the informant from the e-rikshaw, but the petitioner
Patna High Court CR. MISC. No.70286 of 2025(2) dt.08-10-2025 2/3 is only driver of the said e-rikshaw and nothing incriminating has been recovered form his conscious possession. The petitioner is having antecedent of three cases. The petitioner is in custody since 12.02.2025 and charge-sheet has been submitted.
05. Learned APP for the State opposes the submission made on behalf of the petitioner. Learned APP submits that the petitioner and co-accused were apprehended by the police party after the informant called them by dialing 112 just after the robbery. The petitioner and co-accused purchased mobile phones from the looted cash and the mobile phones with boxes were recovered from them.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 75 of 2025, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:

(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
