2. The petitioner seeks bail in connection with Sessions Trial No. 401 of 2023 arising out of Gangabridge P.S. Case No. 126 of 2020 registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.

3. The deceased was the wife of the petitioner. They had a small child. It has been submitted that the deceased died due to illness and because of some dispute over property, this case has been registered. The petitioner is in custody since 02.02.2023. It has further been submitted by Mr. Rajeev Ranjan, Advocate on instruction that the trial has begun and the mother of the deceased has become hostile.

4. Learned APP appearing for the State opposes the

Patna High Court CR. MISC. No.72832 of 2023(2) dt.09-11-2023 2/2 prayer for regular bail of the petitioner.

5. Considering the fact that the trial is proceeding and the petitioner has a small child who has to be looked after, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Vaishali at Hajipur in connection with Sessions Trial No. 401 of 2023 arising out of Gangabridge P.S. Case No. 126 of 2020.

7. The petitioner will co-operate in the trial. He will appear regularly either personally or through his lawyer so that the trial is not delayed. In case of non-cooperation by the petitioner in the trial, his bail bonds shall be cancelled by the trial Court.
