2. The petitioner is in custody in connection with Chautham P.S Case No. 353 of 2023 registered for the offences punishable under Sections 394 and 120(B) of I.P.C.

3. As per prosecution case, allegation against the petitioner along with other co-accused persons is to have assaulted and confined the informant in a room and thereafter taken away all the loaded goods on the magic vehicle belongs to the informant after uploading the same to another pick-up vehicle.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.69824 of 2025(8) dt.19-12-2025 2/3 petitioner has falsely been implicated in this case. It is further submitted that earlier prayer of petitioner for regular bail was rejected by this Court in Cr. Misc. No. 27304 of 2024. It is also submitted that petitioner is in judicial custody since 02.11.2023.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order, it appears that petitioner is arrested on the spot with loaded articles. On further perusal of the status report of trial sent by the concerned trial Court where it is mentioned that charges were framed but prosecution witness is not examined yet. It seems that progress of trial is very slow.

7. Considering the aforesaid facts that progress of trial is very slow, circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M 1st Class, Khagaria in connection with Chautham P.S Case No. 353 of 2023, subject to the condition that petitioner shall present

Patna High Court CR. MISC. No.69824 of 2025(8) dt.19-12-2025 3/3 physically before trial Court on the date fixed by the trial Court till conclusion of the trial, if petitioner fails to present physically on any date then concerned trial Court shall cancel his bail bond.
