JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 This is an application for grant of anticipatory bail in connection with Jehanabad Mahila P. S. Case No. 28 of 2019, disclosing offences under Sections 498A, 494, 34 of IPC and Section 3⁄4 of Dowry Prohibition Act.
As per F.I.R. allegation against the petitioner of demand of Rs.1,00,000/- and one motorcycle and also assaulting her for that. Further allegation is that he has married with another lady.
Submission of the learned counsel for the petitioner is that the allegation is false and concocted. He is still ready to keep her with dignity and care.
Heard learned A.P.P. also and perused the impugned
Patna High Court CR. MISC. No.64803 of 2019(2) dt.17-10-2019 2/2 order, from which, it appears that the court below has taken effort for reconciliation but the victim girl has appeared and stated that petitioner has beaten her for demand of dowry and as such, prayer for anticipatory bail was rejected by the court below.
Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, it is open to the petitioner to approach the informant in this case for any settlement and if any settlement is reached between the parties, the learned court below while considering the prayer for bail of the petitioner will consider the same.
