JUSTICE SANJAY PRIYA ORAL ORDER 3/ 22-03-2018 In the instant case, by order dated 17.02.2018, a report was called for from the Court below, which has been received, wherein, it has been submitted that Officer-in-Charge, Mohania, has registered the case on 05.07.2017 although complaint was sent to the Police Station under Section 156(3) Cr. P. C. in the year 2006. The reminder was also sent to the P.S. on 28.01.2011.

Learned Chief Judicial Magistrate, Kaimur at Bhabhua, has further submitted in the report that Investigating Officer has submitted Final Report in the case showing occurrence as untrue. The case is pending for hearing on the Final Report for which notice has been issued to the informant on 16.12.2018.

Patna High Court Cr.Misc. No.8907 of 2018 (3) dt.22-03-2018 2/2 In view of such, this Court does not find any apprehension of arrest to the petitioner in connection with Mohania P.S. Case No.348 of 2017.

The application is, accordingly, dismissed as withdrawn with liberty to the petitioner to file fresh anticipatory bail application in the event petitioner apprehends arrest. (Sanjay Priya, J) JA/- U T
