The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 342, 323, 324, 307, 504/34 of the Indian Penal Code.

Prosecution story relates to assault to the informant by giving hasuan blow in his stomach over a dispute of measuring the land by Aamin.

Learned counsel appearing on behalf of the petitioners has submitted that petitioner is innocent and has been falsely implicated in this case. There is old land dispute between the parties. No injury report is brought on record to support the prosecution story. Petitioner is languishing in judicial custody since 25.07.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM III, Barh, Patna in connection with Bakhtiyarpur P.S. Case No. 38 of 2022.
