The petitioner prays for anticipatory bail in connection Barauni (Chakiya) PS case no. 403 of 2016 registered for the offence punishable under sections 406, 409, 385, 379/34 of Indian Penal Code.

It is submitted on behalf of petitioner that the allegation is of civil nature as it is alleged that the petitioner along with others has sold the land of the informant and he is not allowing the possession of the same to the informant and there are some other allegations also but they are fundamental in nature. Heard learned A.P.P. also.

Having heard both sides. In view of the allegation

No.9965 of 2017 (2) dt.20-03-2017 2/2 as stated above, let the petitioner, named above, in the event of his arrest or surrender in the Court within a period of two weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Barauni (Chakiya) PS case no. 403 of 2016 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
