The petitioner is accused in connection with Samastipur Rail P.S. Case No. 39 of 2016, registered under Section 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but in course of investigation, the name of the petitioner has surfaced in the confessional statement of co-accused, Pappu Kumar. It is further submitted that while petitioner is accused in one another case but in that case, he is on bail and in the present case, he is in custody since 23.11.2016.

No.9727 of 2017 (2) dt.15-03-2017 Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, (Rail) Samastipur, in connection with Samastipur Rail P.S.
