The petitioners apprehend their arrest in connection with Badem O.P. Nabinagar P.S. Case No. 32 of 2018 for the offence registered under Sections 379, 411 and 420 of the Indian Penal Code and Section 4/40 of the Bihar Minor Minerals Concession Rule and Section 8 of Bihar Illegal Mines Act and Transportation and Storage Rule. Learned counsel for the petitioners submits that the vehicles were allegedly detained a day prior to the date of the lodging of the first information report, on which date, the concerned vehicles were having a valid challans for transportation of sand from the area. It is further submitted that the challans which have been referred and stated in the

Patna High Court Cr.Misc. No.16695 of 2018 (2) dt.10-04-2018 2/2 first information report itself were valid till 06.02.2018 and 07.02.2018 respectively. It is, thus, submitted that the entire case is mischievous and has been lodged only to harass the petitioners.

Having considered the submissions of the petitioners and that the petitioners have no criminal antecedents, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., 1st Aurangabad in connection with Badem O.P. Nabinagar P.S. Case No. 32 of 2018, subject to the condition as laid under Section 438(2) Cr.P.C.
