JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-03-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 447, 341, 323, 225, 504/34 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act. Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that sons of the informant were playing game on mobile phone and then petitioner along with another accused asked for the mobile for call. On refusal, they were abused and an altercation took place. In the meantime, informant came and one country made pistol was recovered from the possession of the co-accused and the same was produced before the police by the informant. Other co-accused persons have been granted anticipatory bail by a Bench of this Court.

Having heard both sides, in view of the facts and circumstances stated above, let above named petitioner, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Muzaffarpur, in connection with Katara P.S. Case no. 51 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioner shall cooperate in the investigation and make himself available before the police as and when required.
